KAYAK ANGLER MAGAZINE $20,000 STATE RECORD CHALLENGE
OFFICIAL RULES, ELIGIBILITY REQUIREMENTS and REGULATIONS
The 2009 KAYAK ANGLER Magazine $20,000 State Record Challenge (the Challenge) will be produced and organized by KayakBassFishing.com (the Organizer).

ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. Eligibility determination and compliance with state and local laws is the responsibility of the participant. Participants are responsible for complying with all tax requirements and filing responsibilities.

ELIGIBILITY: Subject to the additional restrictions below, the Challenge is open to continental United States residents (excluding Puerto Rico residents) regardless of state of residency. Applicants must be 18 years old on or before the date they are establish eligibility and participation requirements. Entries are eligible from March 1, 2009 through January 29, 2010. Entries postmarked after January 29, 2010 will not be considered and will not be returned to the entrant. All entries must be submitted within 30 days of the date stated on the official state record acknowledgement. All individuals participating in this Challenge must have a valid state fishing license for the state they are submitting dated prior to the capture of the fish. All applicants must be in excellent physical and mental health and must not have been convicted of a felony at any time or of a violation of any fish and game-related law or regulation. KayakBassFishing.com Pro Staff members and full time benefited employees of Challenge sponsors and their immediate family members of are not eligible to enter to win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children and grandchildren.

HOW TO ENTER: Entry into the KAYAK ANGLER Magazine $20,000 State Record Challenge is established by having a current print or digital four-issue subscription to KAYAK ANGLER Magazine (subscribe at http://www.kayakangleronline.com/subscribe.html) and having a registered user account at http://www.KayakBassFishing.com. After the acquiring of a valid subscription and registration at http://www.KayakBassFishing.com participants must place the following statement: “I have read the rules pertaining to the KAYAK ANGLER Magazine $20,000 State Record Challenge and declare that I will not hold http://www.KayakBassFishing.com, KAYAK ANGLER Magazine or any other sponsor liable for anything that may happen while fishing in pursuit of this Challenge. I assume full responsibility for my actions and any situation that I may find myself in connection with this Challenge. By submitting any entry I attest that I have followed the prescribed parameters and understand that I will be disqualified for failure to do so.” in the Challenges and Rules forum at the following location http://www.kayakbassfishing.com/php...iewtopic.php?f=56&t=8 Organizer will not be responsible for incomplete or illegible applications for any reason, including, without limitation, failure or malfunction of any communications network or equipment or computer software or hardware. All applications become property of Organizer and none will be returned. Due to the large number of applications anticipated, Organizer will not be able to answer any questions about the receipt or status of any application. Organizer reserves the right to contact applicants to ask additional questions and/or conduct phone interviews or other third-parties to gather additional information relating to an applicant’s submission as it pertains to the Challenge.

QUALIFICATION GUIDELINES: All eligibility requirements must be complied with prior to pursuit and capture of the record fish. Anglers may not capture the fish and then establish eligibility by purchasing the KAYAK ANGLER subscription or registering at KayakBassFishing.com after the capture. To qualify for the KAYAK ANGLER $20,000 State Record Challenge fish of eligible species must be awarded the All-Tackle record for the state in which it was caught. Records for line-class and any other type record recognition are not eligible for submission. International Game Fish Association (IGFA) and other record keeping organization records will not be acceptable unless the record is officially recognized by the state sanctioning body as an All-Tackle record for eligible species. Fish may only be caught using artificial lures or fly. No fish caught on live or cut bait will be eligible for submission. Fish must be caught on rod, reel and line. Fish caught using set lines, jugs, bush-hooks, trout lines or any other permanent or temporary means of entrapment are not eligible for submission. Fish that are foul hooked, snagged or otherwise unlawfully entrapped shall not be eligible for submission. Only one award per species will be awarded. If multiple All-Tackle records for the same species are entered, the certified mail date of the first submission shall be declared the sole winner.

PRIZES: Prizes for the Challenge are as follows: Ten thousand dollars ($10,000) in cash for Largemouth (Micropterus salmoides), five thousand dollars ($5,000) in cash for Smallmouth (Micropterus dolomieui), and one thousand dollars ($1,000) in cash for each of the following species Spotted, Shoal (Micropterus cataractae), Suwannee (Micropterus notius), Guadalupe (Micropterus treculii), and Redeye (Micropterus coosae). No hybrid species are eligible for submission. Applicants must be available to attend and participate in the awards ceremony at the 2010 Bassmaster Classic Expo in Birmingham, Alabama and be willing to travel to the appropriate location. KayakBassFishing.com will provide $500 towards travel related expense(s). All other related travel and lodging requirements will be at applicant’s sole expense. Winners may waive their right to receive prizes. Prizes are not assignable and are nontransferable. Winners are solely responsible for reporting and payment of any taxes on their prizes.

SUBMISSION GUIDELINES: Submission must be made via certified mail to Kayak Bass Fishing, 8461 Quincy Street, Norfolk, VA 23503. Submissions must include documentation from the official game agency of each State. In addition, member must submit a photograph of the fish on or in the kayak from which it was caught, a copy of their fishing license and a copy of matching photo identification. Participants must submit a sworn, written statement declaring that the fish was pursued, hooked, and landed from a kayak and all requirements contained within these rules and regulations were complied with prior to capture of the record. Participants must submit to polygraph testing, if requested by the Organizer. Polygraph testing will be conducted at the expense of the Organizer.

RESERVATION OF RIGHTS: Organizer reserves the right to disqualify any participant for any reason, including, without limitation, acting in an unsafe, unsportsmanlike or disruptive manner and/or with intent to intimidate, threaten or harass, or harm another person. Removal or disqualification of a participant will result in removal or disqualification and forfeiture of his or her rights and interests in any prize. All decisions with respect to the removal, disqualification and/or addition of participants shall be made by Organizer and in their sole discretion and shall be final and binding in all respects. Failure to comply with any term or condition of these Official Rules, or the Challenge Rules, may result in applicants or participant’s disqualification, and the forfeiture of his or her interest in any prize. Organizer reserves the right to amend these Official Rules and Eligibility requirements, and/or the Challenge Rules at any time in its sole discretion, and applicants and participants shall have no recourse for any such changes or for any failure (whether inadvertent or otherwise) by Organizer or other participants to follow the stated rules. Organizer also reserves the right to modify and make additions to and/or deletions from the Challenge and to change the date, time, location or format. Organizer reserves the right not to conduct the Challenge. Participants may be required to execute further releases, documents and instruments, as Organizer deems necessary in its discretion. In the event that the Challenge is canceled, no prizes will be awarded. If the Challenge is cancelled for any reason, participants will not be reimbursed or otherwise compensated for any costs or expenses associated with their participation.

PARTICIPATION: By participating in the 2009 KAYAK ANGLER Magazine $20,000 State Record Challenge, applicants agree to be bound by these rules and regulations, and all decisions of Organizer. Organizer reserves the right to disqualify any persons found tampering with or otherwise abusing any aspect of the Challenge as solely determined by Organizer.

CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

ORGANIZER: The Challenge will be produced and organized by KayakBassFishing.com (the Organizer), for KayakBassFishing.com and KAYAK ANGLER Magazine. The decisions of Organizer regarding the eligibility, selection and elimination of participants, the selection of winners, and the production and administration of Challenge-related events, and all other aspects of the Challenge, shall be final and binding in all respects. Organizer will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Challenge duplicated by third parties or other entities not identified as Organizer.

DISPUTE RESOLUTION: Except where prohibited, participation in the Challenge constitutes an agreement that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Challenge, participation therein, or any prizes awarded, shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association in New York, NY, USA; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including only costs associated with entering the Challenge but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages and any and all rights to have damages multiplied or otherwise increased.
